These Terms & Conditions govern your use of the Edith York website and your purchase of products from us. Please read them carefully before placing an order. By placing an order you agree to be bound by these terms.

Who we are
This website is operated by Takeover Enterprises LLC, a limited liability company registered in the State of Wyoming, United States, with its registered office at 30 N Gould St Ste R, Sheridan, WY 82801, United States. Takeover Enterprises LLC is a US company and is not registered for UK VAT. In these terms, "we", "us" and "our" refer to Edith York; "you" and "your" refer to you, the customer.

Scope
These terms apply to all orders placed through the Edith York website. We sell women's fashion and related products to consumers for personal, non-commercial use. By placing an order you confirm that you are at least 18 years old and legally able to enter into a binding contract.
Products and prices
We take care to describe and picture our products as accurately as possible. Product images are for illustration only, and slight variations in colour, texture or measurement may occur.
All prices are shown in pounds sterling (GBP, £) and include VAT where applicable. The price payable is the price displayed at the time you place your order. Delivery charges, where they apply, are shown separately before you complete your purchase.
Your order and how the contract is formed
When you place an order you make an offer to buy the selected products. We will send you an acknowledgement email confirming that we have received your order. This acknowledgement does not mean your order has been accepted.
A binding contract between you and us is formed only when we send you an email confirming that your order has been dispatched. If we are unable to accept your order (for example, because a product is out of stock or there has been a pricing error), we will contact you and arrange a full refund of any amount already paid.
Payment
We accept payment by PayPal and by debit and credit card. Payments are processed securely by our payment providers. We do not store your full card details on our systems. Payment is taken at the time you place your order.
Prices and availability
All products are subject to availability. We may withdraw or amend products and prices at any time before your order is accepted. In the unlikely event of an obvious pricing error, we are not obliged to supply the product at the incorrect price and will offer you the option to reorder at the correct price or to receive a full refund.
Delivery
We deliver within the United Kingdom. Delivery times, methods and any charges are set out in our Shipping Policy, which forms part of these terms.
Cancellation and returns
You have a legal right to cancel most orders within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and we also voluntarily offer a 30-day return period. Full details of how to cancel or return an item, and how refunds are handled, are set out in our Refund & Returns Policy, which forms part of these terms.
Your legal rights under the Consumer Rights Act 2015
Nothing in these terms affects your statutory rights. Under the Consumer Rights Act 2015, the products we supply must be of satisfactory quality, fit for purpose and as described. If a product is faulty, not as described or unfit for purpose, you may be entitled to remedies including:
- the short-term right to reject the goods and receive a full refund (normally within 30 days of receipt);
- repair or replacement of the goods;
- a price reduction or the final right to reject the goods, where a repair or replacement is unsuccessful.
These statutory rights cannot be excluded or limited, and they apply in addition to any voluntary rights we offer.
Intellectual property
All content on this website, including text, images, logos, graphics and the Edith York name and branding, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute or use any content for commercial purposes without our prior written permission.
Limitation of liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law, including your statutory rights as a consumer under the Consumer Rights Act 2015 and other consumer protection legislation.
Subject to the paragraph above, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not liable for loss or damage that is not foreseeable, or for business losses, as our products are supplied for private use only.
Governing law and jurisdiction
These terms are governed by the laws of England and Wales. If you live in Scotland or Northern Ireland, you may bring proceedings in your local courts, and the mandatory consumer protection laws of your home nation continue to apply. Otherwise, disputes will be subject to the jurisdiction of the courts of England and Wales.
Changes to these terms
We may update these terms from time to time. The terms that apply to your order are those in force at the time you place it. We encourage you to review this page periodically.
